In the following, we would like to inform you about which personal data Wohnmobile Gera processes and for what purposes this is done. We will also inform you about other details that are important under data protection law, e.g. about your rights.

Personal data

The following personal data may be processed by us in connection with our services:

  • Master data: This includes, for example, first name, surname, address (private and/or business), date of birth.
  • Communication data: This includes, for example, telephone number, e-mail address (private and/or business), communication content (e.g. e-mails, letters, faxes).
  • Contract data: This includes, for example, the vehicle information (vehicle type, license plate number, drop-off and pick-up date, booked service) of the vehicle you have ordered.
  • Financial data, such as credit card data.
  • Data of third parties: If you provide us with personal data of third parties in the context of a rental relationship (e.g. of second drivers), we also process this data.

Legal basis

Art. 6 para. 1 sentence 1 letter a) of the General Data Protection Regulation (GDPR): According to this provision, the processing of personal data is permitted if you have given your consent to the processing.

Art. 6 para. 1 sentence 1 letter b) GDPR: According to this provision, the processing of personal data is lawful if it is necessary for the performance of a contract to which you are party or in order to take steps at your request prior to entering into a contract (e.g. when reserving a vehicle).

Art. 6 para. 1 sentence 1 lit. c) GDPR: According to this provision, data processing is lawful if it is necessary for compliance with a legal obligation to which Wohnmobile Gera is subject.

Art. 6 para. 1 sentence 1 letter f) GDPR: According to this provision, the processing of personal data is lawful if it is necessary for the purposes of the legitimate interests pursued by the controller, i.e. Wohnmobile Gera, or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject, i.e. you.

Art. 9 para. 2 letter f) GDPR: According to this provision, special categories of personal data may be processed, inter alia, if the processing is necessary for the establishment, exercise or defense of legal claims.

Reservation and rental of motorhomes

Purposes of the processing

We process your master data, communication data, contract data, financial data and voluntary information for the purpose of booking an appointment, concluding a contract and fulfilling a rental agreement.

We use master data, communication data and contract data for customer support if you contact us as a customer, e.g. in the event of complaints, rebookings …

If you reserve your vehicle via online booking portals or other intermediaries, your master data, communication data, rental information and, if applicable, financial data will be transmitted to us by our partners.

We also use your master data and your contract data for sales processing, e.g. for rental portals.

When renting on account, we process your master and financial data to check your creditworthiness.

After the mutual fulfillment of the rental agreement, your master data, financial data and contract data will remain stored until the expiry of the statutory retention periods.

Legitimate interest, insofar as the processing is based on Art. 6 (1) (f) GDPR

Our legitimate interest in using your personal data to optimize our services and customer service is to offer you perfect services and to intensify customer satisfaction.

Insofar as the processing of the data concerns the purpose of preventing damage to our company or our vehicles through appropriate analyses, our legitimate interest lies in ensuring payment security and preventing economic disadvantages, e.g. through payment defaults or the loss of our vehicles.

Purposes of the processing

We process master data, communication data, contract data and financial data for the purpose of fulfilling legal obligations. This includes the processing of data in the context of obligations to provide information to authorities and processing in accordance with tax regulations (e.g. the obligation to retain commercial trading books and accounting documents in accordance with ? 257 para. 4 of the German Commercial Code).

Purposes of the processing

We process your master data, communication data and contract data as well as voluntary information for the purpose of process and offer optimization.

This includes, for example, the creation and evaluation of the analysis and elimination of quality defects and the implementation of customer satisfaction surveys. We also process your master data and contract data to optimize our range of services.

We also process your master data, communication data and contract data as part of the cooperation with our partners, e.g. rental portals, for the purpose of optimizing the main processes and offers (e.g. appointment reservation).

Regulatory offenses, damage and accidents

Purposes of the processing

In cases where you notice damage to our vehicles, or damage is caused by you or another person, or you or another person are involved in an accident with one of our vehicles, we process your master data, communication data, contract data and financial data for the following purposes:

  • Receipt and processing of complaints,
  • Customer care in the event of damage,
  • Settlement of claims and
  • Processing of accident damage (processing on the basis of your details and those of third parties, e.g. the police, subsequent tenants).

This also includes the processing of data for the purpose of claims settlement, e.g. vis-à-vis insurance companies.

Furthermore, we process your master data, communication data and contract data for the purpose of fulfilling legal obligations (e.g. notifications to investigating authorities).

If you are suspected by the competent authorities of having committed an administrative offense or a criminal offense with one of our vehicles, we process the data transmitted to us by the competent authorities in addition to the master data stored by us.

We also process your master data, communication data, financial data and contract data for the purpose of securing and enforcing our own claims against you, e.g. in the event of payment defaults.

Our legitimate interest in processing your personal data for the purposes of claims settlement and the enforcement of our own claims against you is to avert damage to our company and to keep undamaged vehicles available for our customers. In addition, we are also obliged to process your data for the purpose of claims settlement due to contractual relationships with third parties (e.g. insurance companies). Our legitimate interest in this respect is to be contractually compliant.

We disclose your data to the following recipients for the above-mentioned purposes: Authorities (investigating authorities; regulatory authorities; police authorities), debt collection companies, appraisers, lawyers and insurance companies.

Purposes of the processing

Personal data is collected via the Wohnmobile Gera website if you provide it to us voluntarily, e.g. when contacting us, by filling out forms, by sending e-mails or, above all, by booking a service. We use this data for the purposes stated or resulting from the request, for example, the appointment request for booking a service.

Security, SSL technology

Wohnmobile Gera has taken technical and organizational measures to protect your personal data, in particular against accidental or intentional manipulation, loss, destruction or access by unauthorized persons. These security measures are continuously adapted in line with technological developments. The transmission of personal data between your computer and our server is always encrypted (SSL procedure, Secure Socket Layer).

Online tracking

Some newer browsers use “Do Not Track” functions. If this is the case, our website may not respond to “Do Not Track” requests or may not be able to read the headers of these browsers.

Cookies

When you visit our websites, information in the form of a “cookie” may be stored on your computer at our instigation. “Cookies” are small text files that are copied from a web server to your hard disk. On our website, we use the so-called Facebook Pixel of the social network Facebook, which is operated by Facebook Inc, 1 Hacker Way, Menlo Park, CA 94025, USA, or, if you are based in the EU, by Facebook Ireland Ltd, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland (Facebook). This function is used to present interest-based advertisements (Facebook ads) to visitors to our website when they visit the Facebook social network. Recipients of your data

Data will only be transferred to third parties if this is necessary for the fulfillment of the contract, e.g. to process a credit card payment via your credit card company.

In addition, data is transmitted to Google, Inc. and Facebook Ireland Ltd. to the extent described.

As part of our fraud prevention measures, we also transmit personal data to third parties who have actually suffered or are threatened with fraud in cases of identified or imminent fraud.

Data protection for applications and in the application process for job vacancies

The controller collects and processes the personal data of applicants for the purpose of handling the application process. Processing may also be carried out electronically. This is particularly the case if an applicant sends the relevant application documents to the controller electronically, for example by email or via a web form on the website.

If the controller concludes an employment or internship contract with an applicant, the transmitted data will be stored for the purpose of processing the employment or internship relationship in compliance with the statutory provisions. If the controller does not conclude a contract with the applicant, the application documents will be automatically deleted six months after notification of the rejection decision, unless deletion conflicts with any other legitimate interests of the controller.

Another legitimate interest is, for example, a burden of proof in proceedings under the General Equal Treatment Act (AGG).

Duration of storage

Wohnmobile Gera stores your personal data until the purpose on which the processing is based no longer applies. If Wohnmobile Gera is legally obliged to store personal data, it will be stored for the duration of the legal obligation. If necessary, your data will be blocked for ongoing operations during this time, provided there is no other purpose for processing.

Rights of the data subjects

 

Rights pursuant to Art. 15 § 18, 20 GDPR

You have the right to request information from us at reasonable intervals about your stored personal data (Art. 15 GDPR). This information extends to the question of whether Wohnmobile Gera has stored personal data about you and, among other things, what data is involved and for what purposes the data is processed. Upon request, Wohnmobile Gera will provide you with a copy of the data that is the subject of the processing.

In addition, you have the right to request Wohnmobile Gera to correct incorrectly stored data (Art. 16 GDPR).

You also have the right to demand that Wohnmobile Gera erase your personal data (Art. 17 GDPR). Among other things, we are obliged to erase your personal data if it is no longer required for the purposes for which it was collected or otherwise processed, if you have withdrawn your consent or if the data has been processed unlawfully.

Under certain conditions, you have the right to restrict the processing of your personal data (Art. 18 GDPR). This includes if you dispute the accuracy of your personal data and we must verify your objection. In this case, your data may not be further processed by us, with the exception of storage, until the question of accuracy has been clarified.

If you wish to switch to another service provider, you have the right to have the data that you have provided to us on the basis of your consent or on the basis of an existing contractual relationship with you handed over to you in a machine-readable format or transferred to a third party at your discretion (right to data portability, Art. 20 GDPR).

 

No contractual or legal obligation to provide the data

You are not contractually or legally obliged to provide us with your personal data. However, please note that you cannot enter into a contract with us for the use of our services or the rental of a vehicle from us if we are not permitted to collect and process the data for the aforementioned purposes.

Right to object at any time pursuant to Art. 21 GDPR

If the processing of your data by Wohnmobile Gera is based on the performance of a task carried out in the public interest or in the exercise of official authority (Art. 6 para. 1 sentence 1 letter e) GDPR) or if data processing is based on legitimate interests of Wohnmobile Gera, you have the right to object to the processing of your personal data at any time for reasons arising from your particular situation. Wohnmobile Gera will then cease processing unless we can demonstrate compelling legitimate grounds for the processing which override your interests in the cessation of processing.

You can object to the processing of your personal data for direct marketing purposes at any time without restriction.

Right to withdraw consent at any time

If the data processing by Wohnmobile Gera is based on your consent, you have the right to withdraw your consent at any time. The legality of the processing carried out on the basis of the consent until the revocation remains unaffected by the revocation.
